1st July 1768
Then personally appeared John Wood Sole Executor of Matthew Wood late of Wakehill in the Parish of Kirkby Malzeard Yeoman his late Uncle deceased, who was sworn duly to execute and so forth before me
Tho. Greenbank, Surrogate

In the name of God Amen, I Matthew Wood of Wakehill in the Parish of
Kirkby Malzeard in the County of York, Yeoman being old and weak of Body but
of sound and perfect mind and memory. Praised be Almighty God for the same,
Do make and Publish this my last Will and Testament in manner and form following
(that is to say)

First I give and bequeath unto John Wood my Nephew the Son of Joseph
Wood my Brother, and to William Wood, James Wood, and Michael Wood
the Sons of William Wood my Brother the sum of fourteen pounds apiece.

I also give and bequeath to Ann Burrill the Daughter of Joseph Wood my
Brother and to Margaret Wood, Mary Wood, Ann Wood and Elizabeth Wood
the Daughters of William Wood my Brother the sum of fourteen pounds apiece.

I also give and Bequeath to John Dallow my Nephew the sum of one pound.

I also give and Bequeath to George Watson my Nephew the sum of ten pounds.

I also give and Bequeath to Agnes Watson my Niece the sum of one Pound.

I also give and Bequeath to Dorothy Carlill, Margaret Watson, Isabel Watson
and Elizabeth Watson the sum of one pound ten shillings apiece. which said
Several Legacies or sums of money I will and order shall be paid to the said Legatees
within Six months after my Decease by my Executor as hereafter named to as many
of the said Legatees as shall then have attained the age of twenty one years.

I also give and Bequeath to Mary Horner my niece her heirs or Assigns the sum
of two pounds the first year after my Decease, and one pound Yearly and Every year
for seven years after.

I also give and Bequeath to Geofrey Watson my Nephew the sum of three pounds
when he shall attain the age of twenty one years.

I also give and Bequeath to John Wood, my Nephew, Ann Burrill my Niece,
Son and Daughter of Joseph Wood my Brother William Wood, James Wood, Michael Wood, Margaret Wood, Mary Wood, Ann Wood, and Elizabeth Wood Sons and
Daughters of William Wood my Brother the sum of six pounds apiece, which said
Several Legacies or Sums of money last mentioned I will and Order shall be paid to the Several Legatees within Six months next after the Decease of William Wood my
Brother aforesaid by my Executor hereafter named. And in case any of the above
said Legatees be not content with his, her of their, respective Legacy and bequest and
Refuses to give a proper Discharge when the same comes due and payment tender’d,
then my will and mind is that the Legatee or Legatees So refusing or making
objection, shall have no share or Legacie by Virtue of this my last Will, and I do hereby revoke my gift to such any thing said above to the contrary notwithstanding.

I also give and Bequeath to William Wood my Brother aforesaid and Mary his
wife and the longer liver of them During their Natural lives the use, Rents, issues and profits of the west end of the House wherein I now dwell containing one low Room with chamber over it, together with a turf house Containing one length of Timber in the
west end of the turf house as the same is now Called, and after the decease of
William Wood and Mary his now wife I give Give the said Dwelling House and
turf house to the sons or Daughters of William Wood aforesaid to be a home or
residence if they choose there to Dwell during the Natural lives only of Such as are
not, nor ever were married.

I also give to William Wood my Brother two pounds Yearly During his Natural life to
be paid at two half year payments, the first payment to be made the half year Day
after my Decease the other payment at the Years end or Day of my Death and so
continue till the Day of his death as aforesaid. And if Mary Wood his Wife Survive
the Said William Wood then I give to her for term of Life one pound yearly to be
paid in like manner, and in case any of the children of the said William Wood my
Brother Die before his, her or their respective Legacie becomes due, then in such
Case my will and mind is that the share or Legacie of such shall go to their heirs or
assigns. And for default in payment of all or any of the above said Legacies and
Annuitys or any part thereof when the same comes due, then my Will and is that
they the said Legatees or any of them shall and lawfully may enter into and upon
my Account Lands at Wakehill aforesaid called west close, Sowr close, wellgarth
and Intack and have held possess and enjoy the same or sell and dispose thereof to
the intent of each respective Legacie and Annuity be fully paid with all cost in Law
about the same According to the intent and meaning of this my last will will.

And further my will and mind is that my Executor Shall find and provide Sufficient and Enough of peats or turfs for Mary Wood his Mother during life if she survive her
husband and Continues his Widow, but not if in case she marries and for default I
charge ten shillings yearly to provide the same with all to be paid her out of my lands
and tenements at Wakehill aforesaid.

And Lastly I give and bequeath to John Wood my Nephew the son of William
Wood my brother All and Singular my houses, Barns, Lands tenements farm hold and premises with appurtenances at Wakehill aforesaid and elsewhere to him my Said Nephew his Executors, Administrators or Assigns for and during the full end and
termination of my title and Estate therein Subject nevertheless to the payments above mentioned Charged upon the same And all the rest residue and remainder of my goods, Chattels and personal Estate of what nature or kind so ever (except the West End of the dwelling house and turf house reserved for the use that
William Wood and Mary his wife & their Children keeps unmarried, after their
Deceases) I give and bequeath the Same to John Wood Son of William Wood
aforesaid.

And I do hereby nominate and appoint him the said John Wood my Nephew Son
of William Wood my brother whole and Sole Executor of this my last will and
testament, hereby revoking all former Wills by me made.

In Witness whereof I Matthew Wood have hereunto Set my hand and Seal this
tenth day of August in the Year of our Lord God One thousand Seven hundred and
Sixty Six.

Signed, Sealed, Published and Delivered by the above named Matthew Wood to be
his last Will and testament in the presence of us, who have hereunto Subscribed
our names as Witnesses in the presence of the Testator
