Spence to Pickersgill Draft: Statutory Declaration
by Mr John C. Spence as to the
intestacy of Mr Christopher Spence and as to the heirship of
Mr Thomas Spence
In the matter of the sale of freehold land called “Town End Closes”
at Galphay in the County of York by Mr Thomas Spence to
Mr Christopher Pickersgill
I John Cooper Spence of Fountains, near the City of Ripon in the County of York,
Corn miller for the satisfaction of the Purchaser do solemnly and assuredly declare
as follows:
1. Christopher Spence of Fountains aforesaid, Yeoman, my late Father, died on the
26th day of October 1862 intestate seized of 2 closes or parcels of freehold land called
“Town End Closes” containing together about 3 acres, situate near to the Village of
Galphay in the Parish of Kirkby Malzeard in the said County
2. My elder Brother Thomas Spence late of Aldfield near the said City of Ripon,
and now of High Grange near Melsonby, in the said County, Farmer, was the eldest
son and heir at law of my said late Father, Christopher Spence, deceased, at the
time of his death
3. And I make this Solemn Declaration conscientiously believing the same to be true,
and by virtue of the provisions of an Act made and passed in the Sixth year of the
Reign of his late Majesty King William the Fourth intituled
“An Act to repeal an Act of the present Session of Parliament intituled An Act for the
more effectual abolition of oaths and affirmations taken and made in various
departments of the State, and to substitute Declarations in lieu thereof and for the
more entire suppression of voluntary and extra-judicial oaths and affidavits, and to
make other provisions for the abolition of unnecessary oaths”
Subscribed and declared at Ripon, in the
County of York this 15th day of August 1878.

Agreement
I James Whitwham of Swetton in Dallowgill, in the County of York, Farmer,
do hereby declare myself the Purchaser by private contract of the premises
comprised in the foregoing particulars at the price or sum of seven hundred
and seventy five pounds subject to the foregoing conditions of sale as far as
the same as applicable to a sale by private contract which I agree to fulfil in
all respects, and
I Thomas Spence do hereby accept the said James Whitwham as
Purchaser thereof accordingly and agree to fulfil the same conditions on my
part, the purchase to be completed on the 15th day of August 1878
