Belforth. Sale to Ellen Pearson of Skelding 1885
This Indenture made the 26th day of November 1885
Between Samuel Ward of Hill Top House, Hartwith, near Ripley,
in the County of York Farmer of the one part and Ellen Pearson
of Skelding, near Ripon in the said County, Spinster of the other part.
Whereas an Indenture made the 23rd day of December 1869
between William Atkinson of the one part and Richard Weatherhead
therein described of Brimham Rocks House in the Parish of
Kirkby Malzeard, in the said County Farmer of the other part the
messuage or dwelling house, land and hereditaments hereinafter
described and expressed to be hereby conveyed were assured unto
and To the use of the said Richard Weatherhead his heirs and assigns
or ever.
And whereas the said Richard Weatherhead then of Summerbridge
in the said County made his last Will dated 17th August 1877 whereby
he appointed his wife Hannah Weatherhead, Joseph Kirkley of
North Pasture, near Sawley in the said County and the said Samuel Ward
to be the Trustees and Executors thereof and bequeathed unto his said
wife an annuity of £100 during her life and to Eliza Pearson an annuity
of £40 during the life of his said wife And the said Testator gave devised and bequeathed to his said wife and the said Joseph Kirkley and Samuel Ward
All his messuages, lands, tenements, hereditaments and premises
wheresoever situate and of whatever tenure and all the residue of the
personal estate upon trust for sale and conversion and investment of the
proceeds of his personal estate as therein mentioned and after answering
the annuities and legacies bequeathed by the said Will and of all the costs
of keeping his Real and Leasehold estate in good repair to accumulate as
therein mentioned the rent and interest of his residuary real and personal
estates during the life of his said wife And from and after her decease
Upon trust to sell all his Real and Leasehold estates together or in parcels
by public auction or private contract with power to make any special
conditions as to title or evidence of title or otherwise and with power to buy
in the premises at any public sale or to rescind either on terms or gratuitously
any contract and to resell without being answerable for any consequent loss
and to convey and assure the premises so sold to the Purchaser or respective Purchasers thereof and to give all necessary receipts relating thereto
And the said Testator empowered his said Trustees to give receipts for all
monies and effects to be paid or delivered to them by virtue of his Will
And he declared that such receipts should exonerate the persons taking the
same from all liability to see to the application or disposition of the money
or effects therein mentioned.
And whereas the said Testator died on the 7th December 1877 without
having altered or revoked his said Will which was on the 25th day of March
1878 duly proved by the said Samuel Ward alone in the Principal Registry
of Probate Division of the High Court of Justice
And whereas the said Joseph Kirkley died in the lifetime of the said Testator
namely in the month of October 1877 and was interred at Middlesmoor in the
County of York
And whereas the said Hannah Weatherhead, the Widow of the Testator,
died on the 12th day of February 1885 and was interred at Dacre Banks in
the said County of York and her Annuity was duly paid up to the day of her
decease
And whereas the said Samuel Ward has agreed with the said Ellen Pearson
with the absolute sale to her of the messuage or dwelling house, land and hereditaments hereinafter described and the inheritance thereof in fee simple
in possession free from incumbrances for the sum of £590.
Now this Indenture witnesseth that in pursuance of the said agreement and in consideration of the sum of £590 sterling paid by the said Ellen Pearson to
the said Samuel Ward (the receipt of which said sum the said Samuel Ward
doth hereby acknowledge) The said Samuel Ward as Trustee doth hereby
grant and convey unto the said Ellen Pearson and her heirs,
All that messuage or dwelling house now commonly called “Belford” with
the farm buildings and out-offices Yards and Gardens thereunto belonging
And also all those several closes or parcels of land adjoining or lying near
to the said messuage containing altogether 10a 2r 33p or thereabouts all
which said Messuage, land and premises are situate in the township of
Laverton in the Parish of Kirkby Malzeard aforesaid and are now in the
occupation of John Leeming as tenant thereof and are more particularly
described in the Schedule hereunder written and the said lands are also
delineated on the Plan on the said recited Indenture and thereon shaded
round with a Green verge line To hold the same messuage or dwelling
house, land, hereditaments and premises Unto and to the use of the said
Ellen Pearson her heirs and assigns for ever.
In witness whereof the said parties to these presents have hereunto set
their hands and seals the day and year first hereinbefore written.

in separate Lots the following Freehold farms situate in the Parish of
Kirkby Malzeard
Vicar Pasture Farm in Dallowgill containing 79 acres or thereabouts
in the occupation of Messrs Whitwham
Azerley Grange Farm in the Township of Galphay and Laverton
containing about 70 acres in the occupation of Messrs Whitwham
Belforth Farm in the Township of Laverton containing about 11 acres
in the occupation of Mr Leeming
