1690. Will of John Braithwaite
In the name of God Amen the three and twentieth day of November
in the second year of our Sovereign Lord and Lady William and Mary
by the Grace of God King and Queen of England, Scotland, France
and Ireland Defenders of the Faith etc and in the year of our Lord God
one thousand and six hundred and ninety
I John Brathwaite of Leeds in the Province of York, Shoemaker by
at present by the hand of God upon me in great weakness of Body but
of Sound and Perfect memory for which I praise Almighty God, do
make ordain and constitute this my last Will and Testament in manner
following
First I commend my soul into the merciful hands of Almighty God my
Creator and commit my body to this Earth from whence it came to
have a decent and Christian Burial and as for my temporal estate
I give devise and dispose thereof as followeth:
First I give and bequeath unto my Brother in Law Gilbert Metcalfe
five shillings and to my Brother in Law David Richmond one shilling
and to Richard Richmond my Brother in Law ten shillings and to my
Sister in Law Ellen Weldon one shilling and to my step mother
Ellen Braithwaite one shilling
Item: I give and bequeath to William Richmond son of
Charles Richmond late of Kirby Malside, four pounds and to Mary my
Aunt one shilling and to Lucy Wood one shilling and to Anne Horner
my Aunt one shilling and to Christopher Ripley of Ketsmoore one shilling
Item: I give and bequeath to John Smith of Leeds Shoe Maker my Cozen
ten shillings
Item: I give and bequeath to my Halfe Brother William Braithwaite fifty
shillings which last Legacy my mind and Will is shall be paid within Three
Years After mine Executor hereinafter named shall Arrive and Attain to the
Age of one and Twenty Years
Item: My mind and will is that my Brother in Law Richard Smith and
Isabell his Wife my Sister or the longer liver of them Shall Enjoy All my
real Estate of house and Land situate in Carlesmoor in the Parish of
Kirby Malside in the County of York and receive the Rents Issues and profits
thereof until Francis Smith mine Executor hereafter named shall Attain
unto the full Age of one and Twenty Years to their own uses paying and
Discharging all the Legacys above bequeathed (saveing as above limited)
and my funeral Expenses and Also a Legacy of seventy pounds to my
Brother William Braithwaite according to my Fathers Will
Item: I give and bequeath unto my Nephew Francis Smith above mentioned
and to his heirs forever all that my real Estate above mentioned both of house
and Land situate in Carlesmoor aforesaid to enter thereto as soon as he
shall Attain to the Age of one and Twenty Years and not before, if either his
Father or Mother be living
Item: my mind and will is that the said Francis Smith shall pay unto his
Sister Margarett Smith thirty pounds within Six months next after he shall
enter to that Estate which said thirty pounds I give and bequeath to the said
Margarett Smith and to his Sisters Mary and Isabell thirty pounds apiece
when they shall respectively Attain to the Age of one and Twenty Years which
said Sume of thirty pounds apiece I give and bequeath to them out of that
Estate But if it shall happen the said Francis Smith do dye without Lawfull
Issue Then my mind and will is, and I give and bequeath All that my real
Estate of house and Land situate in Carlesmoor aforesaid to my halfe
Brother William Braithwaite and his heirs for ever, he his heirs or Assigns
paying unto Margarett, Mary and Isabell Smith the three Daughters of
Isabell Smith my Sister forty pounds apiece.
Item: all my goods cattells and chattells and personall Estate whatsoever
give and bequeath unto my said Nephew Francis Smith, Son of my said
Sister Isabell Smith whom I do hereby nominate and Appoint Sole Executor
of this my last Will and Testament and my mind and will further is that my
said Brother Richard Smith shall have the Tuition of the said Francis Smith
till he come at full Age and
I do hereby revoke all former Wills by me heretofore made and do Establish
this for my Absolute last Will and Testament contained in two sheets of paper.
In Witness whereof I the said John Braithwaite have hereunto Sett my hand
and Seal the Day and year above written
